Sexual battery case against Sean ‘Diddy’ Combs tossed, citing ‘statute of limitations’

A New York State civil court has dismissed a lawsuit filed against rapper and business mogul Sean “Diddy” Combs by an anonymous plaintiff identified as John Doe.

On Wednesday, Justice Leslie A. Stroth dismissed John Doe’s allegation of sexual battery, according to legal documents. 

The court granted the motion filed by Diddy’s team to dismiss the case in full, citing that the “Plaintiff’s claims are time-barred under all theories of liability.”

The justice ruled that the case was barred by New York’s statute of limitations: the alleged incident occurred around 2015, and at that time the limit was five years. Although the law was later extended to twenty years in 2019, the court ruled that this change cannot be applied retroactively, so the plaintiff’s case was legally “too late” to proceed, she argued.

Court filings stated that John Doe had accused Combs of sexually assaulting him at a party, and claimed that the incident adversely affected his career.

He stated that in 2015, as a 23-year-old emerging artist, he secured a gig at a Los Angeles nightclub where Combs was present. According to John Doe, he was then given a drink, lost consciousness, and later awoke to Combs allegedly engaging in unwanted sexual contact with him.

“Plaintiff John Doe, an aspiring music artist, was invited to perform as an opening act at QC’s 20/20 nightclub in Los Angeles,” the court documents read. “Plaintiff alleges that during the after-party, he was given a drink believed to have been provided by Combs, after which he became disoriented and lost consciousness. Plaintiff claims he witnessed sexual activity involving Combs and others, and later awoke to find Combs engaging in unwanted sexual contact with him.”

Jurors found Combs not guilty of racketeering and sex trafficking in relation to his ex-girlfriend, Cassie Ventura Fine, and a second woman only identified as “Jane.” The jury did, however, convict Combs on two counts of transportation to engage in prostitution.

Comb is currently being held in the Brooklyn Metropolitan Detention Center, where he awaits his October 3rd sentencing.
