Supreme Court Justice Brett Kavanaugh could decide death penalty case

The newest member of the U.S. Supreme Court could soon be the decisive vote in a case involving the planned lethal injection of a death row inmate in Missouri.

Justice Brett Kavanaugh voiced concerns about the state’s plans to execute Russel Bucklew due to a medical condition, according to reports on Tuesday.

Attorneys for the 50 year old claim his condition, which causes blood-filled tumors on his body, could cause undue agony and violate the eighth amendment’s “cruel and unusual punishment” clause.

The case faces a potential deferral back to a lower courts, depending on Kavanaugh’s potential vote.
