Authorities in New Mexico said it’s too early to comment on potential charges in connection to the deadly shooting of a cast member on the set of the movie “Rust.”

During a press conference towards the end of October, investigators said actor Alec Baldwin had been cooperating with authorities and added arrests will be made if the investigation shows a crime occurred. Baldwin has said “there are no words to convey” his shock and sadness regarding the tragic accident.

Cinematographer Halyna Hutchins was fatally shot in early October after Baldwin unknowingly fired a live round from a prop gun that was deemed by crew members as “safe.” Officials said the firearm used during the incident was an F Lee Pietta Long Colt 45 revolver.

“We know there was one live round as far as we’re concerned on set. We’re going to determine whether we suspect that there were other live rounds,” said Sheriff Adan Mendoza of the Santa Fe County Sheriff’s Office. “But that’s up to the testing. But right now, we’re going to determine how those got there, why they’re there, because they shouldn’t have been there.”

Further into the investigation, an additional 500 rounds of ammunition were found on the set that were a mix of blanks, dummy rounds and suspected live rounds.

The film’s director, Joel Souza, was also shot and was released from the hospital. Mendoza said there was approximately 90 people on the movie set itself and many interviews still need to be conducted for the investigation.

How the live rounds got into the gun remains under investigation, but officials assert it will be the key factor in bringing possible criminal charges.

Latest reports have said Hutchins’ family is set to take legal action. A family spokesperson confirmed Hutchins’ husband Matthew has retained legal counsel.

The family reportedly plans to file a wrongful death suit, which will have multiple defendants. However, in the meantime, a spokesperson for the family said Hutchins’ remains focused on taking care of his son and processing his grief.
