DOJ, State Dept. Join Forces to Probe Employment-Based Work Visa Abuse

The DOJ and State Department join forces to investigate companies abusing work visa programs.

Officials agreed to share data on employers who hire foreign workers over American workers.

Employment-based visas include H-1B, H-2A and H-2B visas.

The State Department issues such visas upon request of the sponsoring U.S. employer to bring a foreign worker into the country.

Recently, the DOJ has brought several cases against companies denying employment to U.S. workers in favor of low-skilled and cheap labor.

This comes following an executive order signed by President Trump back in April aimed at reviewing visa program applications as a part of his “America First” agenda.

Discriminating against American workers is against the law, and the Justice Department is taking a closer look at companies who appear to be doing just that.

    The H1B Visa program is HIGHLY abused. I work in I.T. so I’ve seen it first hand. Many many companies have “replaced” American workers with lower paid foreigners. Eventually much of the I.T. skillset American’s “had” will be lost, if this keeps up. They need to cut the number of H1B Visas by at least 90 percent.

Then they steal the lives of the remaining workers by having them do the jobs of 3-4 people that have been laid off and training the offshore people so they can take even more American jobs. All so executives can get their undeserved bonus checks.

    President Trump needs to have every officer in the military sign an oath that they fully support him. Currently there are many Obama appointed officers who have moved the Chain of Command pictures to less prominent places in military facilities and are openly refusing to support him.     This is the dumbest things the obama Administration did was allow the DOL to set rates on these worker. I own a Landscaping company and cant find workers that come to work every day. The DOL raised the minimum wage for our area from $9.00 2 years ago to now $11.80 an hour and this year expected at $12.23. But before we can hire these H2B workings we put add in paper making this opportunity available to ALL AMERICANS. But having a Welfare system, food stamps, 8A housing they only need work 20 hours a week to be legible. WHY WORK! Oh and let me say this as well if a worker works 200 hours and get fired for any reason they get Unemployment. Our unemployment rates sky rocket and they receive money and we have to fight to get it dismissed even when 2 employees were smoking Marijuana while driving my work truck! I fired them had 3 arbitration hearing with Unemployment had Employee handbook they read and signed on final hearing I told the Arbitration officer I would take them to court if they gave them unemployment again 2 weeks later they were denied. SO Why why WORK. So lets punish Corporations lets punish people that form our middle class. Shameful what this country doing to SMALL BUSINESS! I know some of you think the same as many we are not employing American workers but we want to we do and its a revolving door. I had the same feeling 14 years ago when I first hired H2B worker. I said for years i was not going to give American jobs to H2B and I suffered I had to hire extra people just to fill in on days they didn’t show up. I got tired of it and I got 10 H2B I was doing more work I was able to grow $650,000 corporation to 1.2 million. I have American worker and I love them they come in every day and give me a good days work I have them year round even when there is no work in winter but we fix our fleet. I was allowed to paid them minimum wages $7.25 but 14 years ago they started at $9.00 an hour and after first year they got $9.30 supervisors back then made $13 $14 hour everyone was happy. The way to get Americans to work again is to stop giving them free EVERYTHING. I am AMERICAN Latino not a hater or racist I have White, Black, Cuban, Puerto Rican, German, Irish, Filipino, Italian family.

    So happy to hear this. India based IT firms like InfoSys and TaTa have taken thousands (possibly millions) of American IT jobs away. Just look at the big financial and insurance companies around NYC, they have been taken over by these off-shore firms.

      USAA insurance for our vetarans or military families fired American workers and outsourced…26,000 jobs to Indians. TCS (Tata Consultancy Services) has 12,000, Wipro 5,000, Infosys, Cognizant, HCL, etc.. Nielson Ratings service has over 12,000 Indians (mostly TCS per the partner who sold the deal), PricewaterhouseCoopers outsourced just about everything to TCS for a $425M 5 year contract (true – I worked with the guy who sold it and he go about $600,000 in salary that year – it was capped), I have over 700 companies names with the number of outsourced consultants and the type of work they are doing for the company.

      They told us to sell Engineering, Product Development, IT integration, IT development, web development, Call centers, sales, telemarketing, Application support & maintenance, Infrastructure support and maintenance, and BPO (Business process outsourcing) including finance, tax, recruitment, HR, benefits, payroll, printing, marketing, medical billing, transcription services, etc..
      Now they are looking at building our military planes in India.

      Prime Minister Modi is leading a Build in India campaign. Also, TCS, Wipro, Infosys’s revenue is 70% from the United States. If they don’t have us these guys will go home and our people who are no longer on the unemployment roles will go back to work. If a company (Silicon Valley cos) still want these people then they will pay a 30% tax on their rates. That tax can go towards building a wall..

        It is not that USAA actually fired employees, they just never replaced employees that were lost to attrition. Their current business model is to keep a bare minimum of US citizens to maintain and produce new functionality. Most of those are full-time employees that manage at a minimum of 10-15 onshore/offshore TCS and HCL employees on any given project. So to say they fired them is a little far fetched, but they did not hire as many US citizens either.

          I agree. But then why did they hire 12,000 TCS consultants? I’m out of Dallas and I actually know the person who runs the engagement. I know exactly how many people were there before and after. Sounds like you work there or were a previous employee but the bottom line is there’s a lot of jobs that are no longer in the US that could’ve gone to an American citizen. I think we’re on the same page but the point still remains why would a company like USAA the services our veterans and military families take jobs away from Americans and give them to foreigners? Especially since we had to set up programs for our military vets to reenter into the workforce to help them find employment. Why not work for USAA? That’s just an example. They fired the CIO after he had stellar ratings the year before because he was against this idea and I brought in a guy who was pro outsourcing. When we sell the stuff it’s a 30% immediate reduction and spend and if it’s going to cloud-based services has moved its position on the piano. Bottom line it represents a huge bonus for the CEO. 90% of the executives I’ve had lunch with during the cell cycle say they would not have gone to this company if it wasn’t for a reduction and spend. And they’ve been very disappointed with the service levels and the capabilities of these consultants. If you can broaden Microsoft and other soft for manufactures to vet out the knowledge level these people. I’ve seen the training center in mysore, India for India for infests and they run through thousands of people a day and put them in a three month class and send them overseas as quickly as possible. They self certify.

          We started selling out America 15 years ago. We’re going to see this continue if we don’t do something now. We need to send these guys home and build up our own economy with our own workforce. They’re filling up at colleges taking our stem positions in engineering schools that are already impacted. Our American students need to be in Stem and we need to help them get into these schools not with a 4.0 GPA with more like a 3.0 GPA and allow them to get into a field that allows them to succeed

          Last point Indian IT companies are making 55% to 75% margins at times. Now you know why these guys are full of money and they bleed green.

    During my working career, I worked with legal naturalized citizens who did their jobs well, but when they hire an inferior worker just because he’s an illegal and will take lower wages, they have crossed the line that they should have to pay dearly for.           When I was in Bangalore (I have been to India 12 times) last time I asked the cab driver why they were using mirrors under the car when arriving at my hotel and he said “because of the bombs from the terrorists”. This really bothered me.

The number of companies that actually utilize H1B employees in their IT department is alarming. I worked on a DOD project where the database administrator was an H1B visa holder.

          You are correct. There is no law on the books mandating this. But do it anyway. They will, in most cases honor your request. Yes, some might be able to get you to someone who does not sound like they are foreign. More likely, it’s an American working at the call center. That means an American with a job. Same effect.

          The other option is to ask to speak to the next level support. Tell them this is a repeat issue and the last first level support call didn’t resolve the issue, so you want the next level. Not a supervisor, but a next level tech. In many cases, that gets you back to the US. If it doesn’t, you’ll at least get a more knowledgeable troubleshooter.

            There is nothing smug about wanting jobs for people in the US. When more people are working in good paying jobs, the country benefits. Patriotic, yes, smug, hardly. I won’t believe for a second that you don’t feel the same way about whatever country you live in.

            I never said that the more experienced trouble shooter wouldn’t be foreign.

            There are two issues in this thread. One is about the impact on the US economy by offshoring and the desire by some, including me, to see more of those jobs filled by US citizens, as a practical economic matter given the current economic climate. 20 years ago, I supported and facilitated off shoring efforts. Different times, different needs, different solutions.

            The second is about the ability of call centers to resolve the issues about which they are called. Part of the frustration many experience is both with the technical knowledge of the first level support, as well as with their ability to communicate that in an understandable way. Language barriers and thick accents can diminish the utility of even a competent advisor. If they also have insufficient skills, the effect is exponentially worse and more frustrating. Getting to a second level support improves former, if not the latter. In my experience, it usually results in someone with better language skills, and more often than not, someone who appears to be a native speaker with a US dialect. Could that be trained, yes, of course,but the high cost associated with that would make it unlikely. More likely is that it is an in country US native, or a US based support center.

            It is, generally, part of the offshore staffing strategy to staff the offshore center with experienced, bilingual if possible, expatriates, both in supervisory roles, as well as specifically, to deal with language issues.

            The problem is worse today than it was then because of the dramatic increase in non US based call centers, especially in India and the Philippines. The ramp ups are fast, and the training time is minimal (in terms of language) and the availability of those foreigners with good English language skills gets depleted fast.

He was from Kenya and the boss was concerned about his ability to communicate. How stupid. One, the guy was from the former British colony of Kenya, he likely knew English better than the boss. And he was going to college with a whole bunch of English-speaking students from the local area.
            Now, India and China are going to wipe our “technology asses” because of idiots like you (and Trump). Or, do I get to call Roy Moore unable to hold a Senate seat because he talks funny and doesn’t even know what some political issues like DACA are? It’s time to grow up, LB.

            Like I said, different times. Tech boom, not enough skilled people, then, to do the work. What I want does not matter. What I do does. I won’t work with a tech support person whom I cannot understand, or is not being successful helping me with my issue. I’ll ask for someone else.

            I did not make a blanket statement (the last refuge for a lost debate) about foreigners not be able to communicate. I, along with many other frustrated clients, have encountered people whose accents, dialects and command of the language are serious impediments to their performance. When I encounter that, i either ask for the next level support, or to be transferred to a US based call center (which, by the way, isn’t necessarily 100% effective because there native English speakers that can be equally difficult to understand).

            The point is, if the person isn’t or can’t (by virtue of skill or language barriers) able to provide you with the service you expect, ask for someone else. That is the most effective way to motivate the supplier to do better, correct the problem, retrain or remove the tech who is readily bypassed, and it might even encourage the company to open up more native based call centers.

            The market will win every time, as it should, but consumers should not put up with poor service or things won’t change.

            Business always bends to the needs and desires of their customers. What world do you live in? But that isn’t the point. I get the customer service I expect. I expect a skilled, competent rep that I can understand. If, at first, I don’t, I ask for what I need, and escalate s necessary.

            If more people stopped tolerating substandard service, it would improve. If customers walked away from business that don’t deliver, those companies would change or disappear, and others who better serve would emerge.

            But frankly, I don’t give a hoot what kind of service you get, or who you get it from. As long as I get the service I am paying for, from whom I pay, when I am supposed to get it, I’m happy.

            I, and others, simply made two reasonable suggestions when faced with poor, offshore based customer service. And it works. It’s simple really. If enough people did that instead of getting angry because they have to put up with bad service, things would change because it would affect the company’s bottom line, if not the top line.

            So, I ask again, what is your problem, other than the fact that you are just angry, that causes you to respond with ad hominem attacks.

        Here, here old chap! I agree. I also enjoy conversing in as many languages my little brain can handle. Living in Miami, it comes in handy. I walked in to a furniture store, and asked to see some living room furniture (i do not have an accent at all) the sales rep asked what language i wanted to conduct the purchase under. I said “how bout the one I walked in speaking ?”

      OMG!!!Yes!! I am having issues right now with Sprint and HTC. I’ve spoken with reps in Bogota, and somewhere in Malaysia. Even the chat options are difficult due to the cust svc locations lack of communication with their state-side counterparts. It’s horrible! DONT BUY AN HTC PHONE!

        totally agree. I want to see his Harvard grades and I still refuse to believe he is an American. I still think he is the “dark con of man” sent to destroy America and Americans. He is treasonous trying to form a shadow government, lacks all decency when the new president came on board (in 2008 atleast Bush came out and said that he would not chime in on Obama’s presidency because the guy didn’t need that – class act GW) Not Obama thought, he is hungry for POWER, nothing more, and his wife will run for President in 8 years.       The man is AMAZING. I thank God for him everyday. Think of what a lousy job he has. Every day he is up against the crud of society who go after him, his beautiful classy wife, his son, his daughter, and his 10 yr old little boy. Yet President Trump gets up everyday and fights for US. Yes, all of US. I stand in awe.

    Still working on the cheap labor theories. Short sighted, more USA citizens and legal residents working, the more they will be spending. But playing these kind of games is counter productive. Folks are still sandbagging their cash. They may have more people working (that are willing to work) but they don’t trust the gub to keep it running like this yet.

      Yes…..And while we are at it…..Let’s have a look into the Welfare and EBT and Food-stamp programs, They have been grossly abused for some time now, and need RE-VAMPING.
      Yes, there are persons who TRULY & DESPERATELY& DESERVING need all types of assistance……But it is the LEECHES/LOW-LIFE’S that have been taking Money & Benefits away from them.
      If you are Physically able to do something/anything for your Assistance….You should.
      Even if it is just sitting using your computer hitting your keypad…….Do something useful!

        I was unemployed for a while back in 09-10 and couldnt get food stamps because i didnt have 19 illegitimate kids and was a single male…..

          Exactly. New Orleans native, in my 30s, first home, I used to live in a “transitional neighborhood” and there was Fed $$$ for home renovations. I tried for 3 years and always got the run around. It was Fed$$$ and the program was run by ACORN, this white boy NEVER seemed to get any grant $$$ no matter how early I applied. I saved and used my own $$$$, nothing wrong with that but a good example of racial discrimination. They showed noticible comtempt that I even applied.

            Remember HARP? Another Obama program after the housing crisis. We tried to get help on a property and we couldn’t get HARP and my husband needed help when construction was DEAD and they wouldn’t help him even though he had 3 kids. He said a black woman pulled up in her Mercedes at the Welfare office (where he was seeingif he qualified for any support or food stamps) and he watched her walk in dressed to the nines nine with a Prada purse. She got up to the window and was approved for everything she asked for. She drove off in her Mercedes. My husband was told “sorry we cant help YOU”

            i worked in a large supermarket and i used to call the food stamp fraud hotline on people who showed up like that…I know for a fact that they busted at leas ONE of those welfare queens…

            I see it sometimes at my grocery store. There’ll be two or three women with two different baskets. It was very clear that they were shopping together. When they checked out they had food stamps/Lone Star to check out. Some of the things they bought I couldn’t even think about buying. One basket for one payment and the other for another type payment. They would separate the contents of the baskets. My question is this, does the government have two or more type cards they give to the assistance program? i.e. WIC for milk, food stamps for certain foods and something else for chips, soft drinks etc., etc.? The women had different cards for the food. I remember thinking this is taking a lot of time to check out like the women were checking out.

            YUP….That System, WELFARE-FOOD STAMPS – and anything else that is given out…..REALLY need’s to be RE-DONE.
            It has gotten WAY out of control and is costing us taxpayers a TON of money….And to make matters worse they ( the cheaters) are hurting the truly needy persons that literally can’t live without it! The whole system is corrupt and lazy.
            Most of us commenters have seen some of the “CHEATERS” abusing the system.
            It pizzes me off!!

          Isn’t it amazing how you can work and pay taxes for years To support those programs but when you as a hard working American need some assistance you don’t “qualify” for assistance. It only goes to people with illegitimate children and illegal aliens. Sad state of affairs.

        I worked at Costco in La Quinta, California. Illegals and their families would buy $400 iPads with California Cash Cards. Nice.
