Former Army Sergeant Bowe Bergdahl avoids jail time after pleading guilty to desertion charges.

A judge ruled for Bergahl to be dishonorably discharge and lose his title rank, as well as forfeit his pay.

On Monday, Bergdahl’s lawyers filed a surprise motion to dismiss the case, saying President Trump’s comments influenced the case.

However, that motion was dismissed.

Bergdahl was held captive for five years by the Taliban after leaving his post in Afghanistan back in 2009.

Six soldiers died and several other were injured while searching for Bergdahl.

President Obama brought him back to the U.S. in 2014 in exchange for 5 Taliban soldiers.

Jeffery Nance, and the way that story reads led me to the impression that the ruling wasn’t about Bergdahl, wasn’t about the soldiers who risked life and limb to find him causing some to be seriously and permanently injured; no it wasn’t about that…it was all about President Trump and making him look bad.

    Rumor that a movie would be made. Any proceeds from such a movie should available to help those who were injured or killed in looking for him. He should be subject to Civil Trial, for damages to those men, and their families. And he will always be known as a deserter, in face of the enemy, in a war zone. No one would want to be walking around, having that as a conscience, if he has such. He was not a young, just out of high school, and everyone that I ever knew, rebelled in their teens against their parents, but majority grew out of and the older they got, the smarter their parents seemed.
    Somehow when Obama brought his parents to White House, I did not get that feeling about his parents, but that is no excuse for his actions, or reasons. Everyone is responsible for their own actions and thoughts after age 18 or so. (I am 88, served 26 years in military, so I have credentials to feel disgust, anger, and frustration that someone in their thirties or so, is not more mature. )

    dishonorable discharge is perhaps the most severe punishment which can
    be handed down. The man or woman so convicted will never be allowed to
    vote in any election for the remainder of his/her lives. He/She will be
    denied a passport, thus will never travel outside the US for the rest
    of their lives. As a 3 star with whom I exchange emails put it “he will
    be a walking dead man.”

    I love MAGA and President Donald Trump.
    However in this instance I wonder if his prejudicial comments during the
    campaign and recently reiterated affected the ultimate verdict. Me? A
    firing squad, period! I think it is good POTUS will be outside the US
    for a few weeks because there will be a verbal host of righteous
    protestations forthcoming.

    Meanwhile I leave it up to minds greater than mine to fathom the mercy shown this deserter in time of war.

          Your reply is right on the mark. The problem here is the Judge and what he FELT and it was wrong for it was NOT base in standards of conduct but made up feeling created by lawyers. We have standards we have to have to uphold against feeling or it will destroy institution and culture and society using self-center feeling I am right but that is a Democrat learned feeling. If we have FEELINGS driving behavior and in the Military you cannot win wars with feeling its called discipline which over rides feelings to win and over come.

          I see it differently the fix was in that is why he pleaded guilty to get off. Its political and this judge is there to protect Democrats and President Obama. Lawyers being what they are got with the judge and fixed the case that is why he pleaded guilty for he only got charged with desertion that it. He could keep in 250,000 pay, he got fine only 10,000 dollars and NO jail that is a fix just like Hillary got a FBI, DOJ and CIA political fix.     People are forgetting that the epic battle to defend forward post COP Keating on 3 Oct, ’09 resulted in 8 killed and 22 wounded because helicopters for earlier evacuation were diverted to search for the cowardly POS Breghdahl after he deserted his post. Two medals of Honor were awarded for the brave actions at Keating, but that doesn’t bring back the dead.

    Others from Berghdahl’s unit were also injured in the search. The bastard should be shot by a military firing squad. The so-called military “judge” should also pay an appropriate penalty for dereliction of duty.

            Also, the laws passed by the Legislative Branch under the authority of the Constitution which establishes requirements and criteria, stated at the time that to pass US citizenship, the US citizen parent must have resided in the US for 10 years with at least 5 of those years being after the 14th birthday.
            Obama’s mother was 18 when he was born, so she did not meet the requirements, and if… IF… Obama was born outside of the US he would not have been eligible. If his mother had been 19, he would have been eligible even if born outside of the US.
            His birth was proven, or at least accepted officially, as being in the US.
            His place of birth is not an issue now, even though some still question it.

            The real question is, did he gain Indonesian citizenship when his mother married Soetoro, and if so, did he ever renounce it.

            There are those who simply try to give Vattle’s Law of Nations superiority over everything and declare only those born on US soil, but that is not accurate, and they claim Congress can not change the Constitution by legislation which is true and accurate, but they fail to realize that the Congress can legislate for more control and clarifying definitions and requirements.

            The decision handed down by the Judge Col. Jeffrey Nance went against the UCMJ. Berghdahl deserted his post in a combat zone. Thus desertion in the face of the enemy. He gave information to the enemy (aid and comfort to the enemy) and because others were either injured or killed means his act of desertion got them killed. I don’t know about you but that’s cowardice? Getting him back gave the enemy 5 of their top leaders who could go on to kill other American Soldiers or Allied soldiers. Does anyone remember what used to happen to someone DRUMMED OUT OF THE MILITARY? All epaulets, rank and unit insignia, buttons and decorations were torn from the uniform. If the individual was an officer his sword was broken and the broken hilt given back to remind him of why he was being drummed out. I’m not sure but President Trump is COMMANDER-IN-CHIEF. I seriously believe that he along with the Army Chief of Staff and the Chief of the JAG Corps. could reverse this decision and also charge the Judge in the case of Dereliction of Duty in regard to the heinous weak sentence. This sentence will be a problem for all NCO’s and Line Unit Commanders in the future.
            However, remember that there are millions of veterans in this country. No matter where Bergdahl goes he won’t ever be able to show his face without taking serious flak for what he did. Frankly I think both he and his parents should be stripped of their citizenship and deported immediately.
